IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING JOBGRIN. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE PLATFORM.

1. Introduction and Acceptance

These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the JobGrin platform, accessible at jobgrin.co.in, including its web application, mobile application, APIs, and all related features, content, and services (collectively, the "Platform"), operated by JobGrin ("Company", "we", "us", or "our"), a startup incorporated under the laws of India, with its principal place of business in Rajkot, Gujarat, India.

By registering, accessing, browsing, or using the Platform in any capacity — whether as a Job Seeker, Employer, Recruiter, Visitor, or any other User — you expressly agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies we may publish from time to time.

JobGrin is an online intermediary platform as defined under Section 2(w) of the Information Technology Act, 2000 ("IT Act"). We provide a neutral marketplace that connects Job Seekers with Employers. We do not act as an employment agency, labour consultant, or recruiter on behalf of any User.

These Terms constitute a legally binding contract. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Definitions

The following terms shall have the meanings assigned to them below throughout this Agreement:

Platform

The JobGrin website (jobgrin.co.in), mobile application, APIs, and all associated digital products and services.

User

Any individual or entity that accesses or uses the Platform, including Job Seekers, Employers, Recruiters, and Visitors.

Job Seeker

An individual who registers on the Platform to search for job opportunities and apply to vacancies.

Employer / Recruiter

An individual, company, or HR agency that registers on the Platform to post job vacancies and search for candidates.

Content

Any text, data, resumes, job postings, images, files, or other materials submitted, uploaded, or otherwise made available through the Platform.

Account

A registered user account created on the Platform, including credentials, profile data, and all associated activity.

Services

All features, tools, products, and functionalities made available through the Platform.

Subscription

A paid plan or package purchased by an Employer or Job Seeker to access premium Services.

Personal Data

Any information that relates to an identified or identifiable natural person, as defined under applicable Indian data protection laws.

DPDP Act

The Digital Personal Data Protection Act, 2023, and rules thereunder.

Applicable Law

All central and state laws, regulations, and guidelines applicable in India, including the IT Act 2000, DPDP Act 2023, and the Indian Contract Act 1872.

3. Eligibility

The Platform is intended for users who meet all of the following criteria:

If you are accessing the Platform as a minor (under 18 years of age), you are strictly prohibited from registering or using the Platform. JobGrin does not knowingly collect Personal Data from persons under 18.

Employers and Recruiters must additionally represent that they are duly registered or incorporated entities or individuals lawfully conducting business in India, and that they have the authority to post job listings and engage with candidates.

4. Account Registration and Security

4.1 Registration

To access certain Services, you must create an Account. During registration, you agree to provide accurate, current, and complete information. You must promptly update your Account information if it changes.

You are solely responsible for:

JobGrin will not be liable for any loss or damage arising from your failure to maintain Account security. You must not share your credentials with any third party.

4.3 One Account Per User

Each User is permitted to maintain only one active Account. Creation of multiple Accounts by the same individual or entity is prohibited and may result in suspension or termination of all associated Accounts.

4.4 Account Verification

JobGrin may, at its discretion, require you to verify your identity, mobile number, email address, or business registration details. Failure to complete verification may limit access to certain Services.

5. Terms Specific to Job Seekers

5.1 Profile and Resume

Job Seekers agree to the following when creating and managing their profile on the Platform:

By default, your profile may be visible to registered Employers and Recruiters on the Platform. You may control your profile visibility settings from your Account dashboard. JobGrin is not responsible for communications received from Employers based on your public profile.

Employers and Recruiters agree that all job postings on the Platform shall:

6.4 Content Moderation

JobGrin reserves the right to review, approve, reject, modify, or remove any job posting at any time and for any reason, including for non-compliance with these Terms or our Content Guidelines, without prior notice. Such removal does not entitle the Employer to a refund of any paid Subscription.

6.5 No Guarantee of Hiring

JobGrin does not warrant that any job posting will result in qualified applications, successful hires, or any specific outcome. Employers use the Platform at their own risk and discretion.

7. Content, Intellectual Property, and Licences

7.1 JobGrin Intellectual Property

All rights, title, and interest in and to the Platform, including its design, code, algorithms, databases, trademarks, logos, graphics, text, and all other content created by JobGrin ("JobGrin Content") are exclusively owned by the Company. These Terms do not grant you any ownership rights in JobGrin Content.

You are prohibited from:

You retain ownership of the Content you submit to the Platform. However, by submitting Content, you grant JobGrin a worldwide, non-exclusive, royalty-free, sublicensable licence to store, host, display, and distribute your Content through the Platform, share it with Employers and Recruiters as relevant to the Services, and use aggregated, anonymized data derived from your Content for Platform improvement and analytics.

This licence terminates when you delete your Content or close your Account, except where retention is required by law or for legitimate business purposes.

9.1 Paid Services

Certain features of the Platform are available only to paid Subscribers. Subscription pricing, features, and duration are specified on the Platform and may be updated from time to time with notice.

All subscription fees paid to JobGrin are NON-REFUNDABLE once the subscription period commences. By subscribing, you acknowledge that you have reviewed the plan features and agree that no refund will be issued for partial use, early cancellation, or dissatisfaction with results. This clause does not affect your rights under applicable consumer protection law.

Exceptions to the no-refund policy may be considered only in the following cases:

Refund requests, if applicable, must be raised within 15 (fifteen) days of the payment date by emailing support@jobgrin.co.in with proof of payment.

9.4 Subscription Termination

JobGrin reserves the right to terminate a Subscription if the User violates these Terms. In such cases, no refund will be issued for the remaining subscription period.

10. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, available at jobgrin.co.in/privacypolicy, describes how we collect, use, store, share, and protect your Personal Data. By using the Platform, you consent to the data practices described in our Privacy Policy.

JobGrin complies with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and all other applicable Indian data protection laws. Key principles of our data practices include:

By registering on JobGrin, Job Seekers consent to their profile being made available to verified Employers and Recruiters on the Platform for recruitment purposes. Job Seekers may adjust their profile visibility settings at any time from their Account dashboard.

Employers acknowledge that they act as data controllers in respect of candidate data accessed through the Platform and must comply with all applicable data protection obligations. JobGrin acts as an intermediary/data processor in this context.

11. Platform as Intermediary — No Liability for Third-Party Content

JobGrin is an online intermediary platform. We do not create, verify, or endorse job listings, candidate profiles, resumes, or any other content submitted by Users. We do not supervise, direct, or control the hiring decisions made by Employers, and we do not act as an agent or recruiter for any User.

JobGrin does not verify the accuracy, completeness, legality, or authenticity of any job listing, resume, company profile, or other User Content posted on the Platform. We cannot confirm the identity of any Employer or Job Seeker.

JobGrin will not be a party to any dispute, contract, negotiation, or legal proceeding arising between a Job Seeker and an Employer. Any employment contract, offer letter, or similar agreement is strictly between the respective parties.

Users are solely responsible for exercising their independent judgment in evaluating job listings, candidate profiles, and all other Content on the Platform. JobGrin recommends that Users conduct independent due diligence before applying for jobs or engaging candidates.

12. Disclaimers of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT.

JobGrin does not warrant that:

JobGrin may suspend or discontinue the Platform or any Service at any time for maintenance, upgrades, regulatory compliance, or any other reason, with or without notice.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JOBGRIN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

In no event shall JobGrin's total aggregate liability to you for any claims arising under or in connection with these Terms exceed the greater of: (a) the total fees paid by you to JobGrin in the 3 (three) months preceding the event giving rise to liability, or (b) INR 5,000 (Indian Rupees Five Thousand).

The limitations above shall apply regardless of the form of action, whether in contract, tort (including negligence), or otherwise, even if JobGrin has been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless JobGrin and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

15. Account Termination and Suspension

15.1 Termination by JobGrin

JobGrin reserves the right to suspend, restrict, or terminate your Account at any time, with or without notice, in the following circumstances:

You may close your Account at any time by accessing Account Settings or contacting support@jobgrin.co.in. Termination by you does not entitle you to any refund of paid subscription fees.

16. Grievance Redressal (IT Act Compliance)

In accordance with Section 69A and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, JobGrin has designated a Grievance Officer to receive and resolve complaints from Users.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The parties submit to the exclusive jurisdiction of courts located in Rajkot, Gujarat, India for all disputes arising out of or in connection with these Terms.

17.2 Amicable Resolution

In the event of any dispute, the parties shall first attempt to resolve the matter amicably through good-faith negotiations within 30 (thirty) days of either party giving written notice of the dispute.

17.3 Arbitration

If the dispute is not resolved through negotiation within 30 days, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties (or, failing agreement, appointed by the competent court). The seat of arbitration shall be Rajkot, Gujarat, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

17.4 Injunctive Relief

Nothing in this Section shall prevent either party from seeking urgent or interim injunctive or equitable relief from a competent court to prevent irreparable harm pending arbitration.

18. Modifications to These Terms

JobGrin reserves the right to amend, modify, or replace these Terms at any time. Updated Terms will be posted on the Platform with the updated effective date. Where changes are material, we will notify you via email, in-platform notification, or other reasonable means.

Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must immediately discontinue use of the Platform and close your Account.

19. Third-Party Services and Links

The Platform may contain links to or integrations with third-party websites, services, or applications. JobGrin does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.

20. Cookies and Tracking Technologies

JobGrin uses cookies and similar tracking technologies to improve user experience, analyze Platform usage, and personalize content. By using the Platform, you consent to our use of cookies as described in our Cookie Policy, available at www.jobgrin.co.in/cookies. You may manage your cookie preferences through your browser settings or the cookie consent interface on the Platform.

21. Force Majeure

JobGrin shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, internet or network outages, pandemics, civil unrest, or any other force majeure event.

22. General Provisions

22.1 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any additional guidelines published by JobGrin, constitute the entire agreement between you and JobGrin with respect to the Platform and supersede all prior agreements, understandings, and representations.

22.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

BY ACCESSING OR USING THE JOBGRIN PLATFORM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS, INCLUDING THE PRIVACY POLICY AND COOKIE POLICY INCORPORATED HEREIN BY REFERENCE.
